Doe vs. Unocal: the future of the Alien Tort Claim Act.

Last year Paull Hoffman, a member of our Advisory Council, made a presentation on his work as lead counsel in Doe vs. Unocal, one of the most important human rights cases regarding the Alien Tort Claim Act. Since then, UNOCAL has petitioned for a rehearing en banc against the 9th Circuit decision that upheld jurisdiction to sue UNOCAL for violations that took place in Burma, and the Justice Department has joined the defendants with a brief that attempts to overturn the Filartiga precedent and the whole progeny of ATCA cases.
