Since then, UNOCAL has petitioned for a rehearing en banc against the 9th Circuit decision that upheld jurisdiction to sue UNOCAL for violations that took place in Burma, and the Justice Department has joined the defendants with a brief that attempts to overturn the Filartiga precedent and the whole progeny of ATCA cases.
