The role of national courts in prosecuting gross violations of human rights

Mr Gahima will discuss the role of national courts in prosecuting genocide and crimes against humanity. He will particularly discuss different methods of accountability for gross violations of human rights used in Rwanda and evaluate their weaknesses and strengths with regard to issues of justice, truth, reparation and prevention.

Gerald Gahima is a law graduate of Makerere University, Kampala Uganda and holds a Master of Laws degree from the London School of Economics and Political Science. He practiced law in Kenya before joining public service in Rwanda, where served respectively as Deputy Minister of the Ministry of Public Service, Deputy Minister and Secretary General of the Ministry of Justice, Attorney General and Deputy Chief Justice. Mr Gahima was instrumental in the rebuilding of both the public service and the judicial system of Rwanda following the 1994 war and genocide. He was intimately involved in the formulation of national policy on the issues of justice in general and accountability for genocide and other grave violations of human rights which were committed during the war in particular, the promotion of human rights and the rule of law, legal and judicial reform in post war Rwanda. He was also the government's principal legal adviser and representative on legal aspects of international matters. Mr Gahima served as a consultant to the War Crimes Chamber Project and as an International Judge on the War Crimes and Organised Crime Chambers of the Court of Bosnia Hercegovina. He is currently a Senior Fellow with Jennings Randolph Program for International Peace, United States Institute of Peace. Mr Gahima recently testified before the Congress on "the practice of International Tribunals and their relevance to Military Commissions in Light of Hamdan v. Rumsfeld".
