JNL Intellectual Property Policy
Overview
Intellectual property (IP) is extremely valuable in any academic
enterprise and is really the core asset of the Group. IP encompasses,
among other types: inventions and patents; research data, reports, and
publications; educational materials; and computer software. In
addition to the Notre Dame IP policy, it is useful to have some
succinct guidelines that make sense for the Group.
Policy
Regarding IP, the guidelines below should be followed by each Member
of the Group:
- Be familiar with and make all reasonable efforts to adhere to the
UND IP Policy).
In most circumstances, with exceptions summarized in the formal
policy, UND either owns or must be granted a no-cost or royalty-free
license to use all IP created by faculty, staff, and
students.
- By default, include JNL as an Author (or "Creator") on any piece
of IP that results from (a) discussions with JNL, (b) discussions with
other Group personnel in the context of Group work, (c) use of lab or
computer equipment provided by JNL and/or UND, or (d) funding support
of any type obtained through or with assistance from JNL.
- For exceptions to the default, obtain a written agreement with
JNL, UND, and other necessary parties specifying some other
arrangement.
- To sign over rights to another individual or organization, first
discuss the matter with JNL, and then seek permission from UND.
- As soon as reasonably possible, notify JNL of valuable IP that should be
disclosed to UND.

- JNL should be sent code, documents, and any IP generated by a
Member (1) as the IP reaches mature stages; (2) when the IP is
completed; and (3) when the Member leaves the Group and/or UND.
